Focus on ERS: What happens if I become disabled?
No one wants to consider becoming permanently disabled, especially during these all-important working years. But if it should happen, you may be eligible to receive a disability retirement benefit. Following is some general information about applying for disability benefits for members of the New York State and Local Retirement System. Please review your plan booklet (see below) about the benefits available to you before filing.
Q: What is a disability retirement benefit?
A: It's a lifetime benefit paid monthly to eligible members who are unable to perform their job duties because of permanent physical or mental disabilities.
Q: Are there different types of disability benefits?
A: Yes. Ordinary and accidental disability benefits are available to most ERS members. Benefits, eligibility and filing requirements vary.
Q: How do I apply?
A: You file an application for disability retirement with us. There are different application forms for different tiers and types of disability benefits. If your personnel office cannot provide the form you need, you can check our Web site or contact our Call Center for the correct form (see below).
Q: What happens after I file my application?
A: We review it to ensure it meets the filing and eligibility requirements. If it does, we will request medical reports and documentation from doctors, hospitals or treatment facilities listed on your application. We may also ask you to make an appointment with an ERS-paid physician. A medical board reviews the data and recommends approval or denial.
Q: How long does it take to act on the application?
A: Processing time varies depending on the type of disability you apply for and the nature of the disabilities claimed.
Q: Suppose my application is denied?
A: You can request a hearing. Your request must be in writing and we must receive it within four months of the date of the original determination.
Q: Can I apply for more than one type of benefit?
A: If you are eligible for more than one type of disability retirement, or both service and disability retirement, you can file for all benefits at the same time. If more than one benefit is approved, you will be asked to choose which you want. Be aware, however, that if you file for service retirement along with disability retirement, and the disability is denied, you cannot withdraw the service retirement application if it is after your effective date of retirement.

Q: Is there a deadline for filing an application?
A: There are filing deadlines for each disability benefit. If you do not meet the deadline, you will not be eligible for the benefit.
Q: Can someone else file for me if I'm not able?
A: Any person you authorize with your power of attorney may file the application. In most cases, your employer also has the authority to file an application on your behalf.
