2008 NYSUT Notice of Nomination and Election Campaign and Election Procedures
NOTICE IS HEREBY GIVEN THAT AN ELECTION FOR THE FOLLOWING POSITIONS WILL BE CONDUCTED ON FRIDAY, APRIL 11, 2008, AT 8:30 A.M., DURING THE 2008 NYSUT REPRESENTATIVE ASSEMBLY AT THE NEW YORK HILTON, N.Y., N.Y., IN ACCORDANCE WITH THE PROCEDURES SPECIFIED BELOW.
NOTICE IS HEREBY FURTHER GIVEN THAT NOMINATING PETITIONS FOR EACH OF THE FOLLOWING POSITIONS WILL BE ACCEPTED THROUGH 12:00 NOON THURSDAY APRIL 10, 2008, IN ACCORDANCE WITH THE CRITERIA AND PROCESSES OUTLINED BELOW.
NOTE: IN ACCORDANCE WITH THE TERMS OF THE TRANSITIONAL GOVERNANCE PROVISIONS OF THE UNIFICATION AGREEMENT, THE FOLLOWING 2008 RA ELECTION PROCEDURES SEPARATELY IDENTIFY THE POSITIONS FOR WHICH ALL 2008 RA DELEGATES WILL BE CASTING BALLOTS; POSITIONS FOR WHICH DELEGATES FROM THE FORMER NEA/NY LOCALS WILL CAST VOTES; AND POSITIONS FOR WHICH DELEGATES FROM THE PRE-UNIFICATION NYSUT LOCALS WILL CAST BALLOTS. THESE TRANSITIONAL ELECTION PROCEDURES WILL EXPIRE IN 2011.

IV. TERMS OF OFFICE
THE TERM OF OFFICE FOR THE NYSUT OFFICERS, ALL AT-LARGE DIRECTORS AND ALL ELECTION DISTRICT DIRECTORS SHALL BE THREE (3) YEARS. THAT THREE (3) YEAR TERM SHALL COMMENCE UPON THE CONCLUSION OF THE 2008 NYSUT REPRESENTATIVE ASSEMBLY, AND SHALL END WITH THE CONCLUSION OF THE 2011 NYSUT REPRESENTATIVE ASSEMBLY.
THE TERM OF OFFICE FOR THE AFT STATE DELEGATES SHALL BE FOR THE 2008 AFT
CONVENTION AND FOR ANY SPECIAL CONVENTION OCCURRING PRIOR TO THE 2010 AFT CONVENTION.
V. NOMINATION & ELECTION PROCEDURES
A. NYSUT OFFICERS:
(To be elected by all delegates)
1. Eligibility Requirements for Nomination and Candidacy:
Any member of NYSUT may nominate a candidate to be a NYSUT officer. Membership in NYSUT or NEA/NY for, at least, two (2) years prior to April 10, 2008, deadline for nominations is a condition for being nominated as a NYSUT officer. (NYSUT Constitution Art. VII §2)
Candidates for the offices of President and Executive Vice President shall be nominated on a single slate. (NYSUT Constitution Art. VII §6)
2. Electors:
All in-service and retiree delegates to the 2008 NYSUT Representative Assembly shall be eligible to vote for NYSUT officers.
3. Tabulation:
NYSUT officers shall be elected by a weighted roll call vote. (NYSUT Constitution Article VII §7; Article VIII §1(c); NYSUT Bylaw C (1)(b)). The candidate with the highest vote total for each NYSUT office shall be elected to that office.
Any local wishing to avail itself of the right to cast votes in the NYSUT officer election by secret ballot (NYSUT Constitution Art. VIII §1(d)) must provide to the NYSUT Elections Committee a formal request signed by two officers of the local association, along with written verification (e.g. minutes of the local’s governing board) that the local’s governing body has directed its delegates to vote by secret ballot. In order to provide the NYSUT Elections Committee adequate advance time to prepare the additional necessary secret ballot, both that request and written verification must be provided to the NYSUT Elections Committee by no later than March 24, 2008.
B. AFT STATE DELEGATES and ALTERNATE AFT STATE DELEGATES:
(To be elected by all delegates)
1. Eligibility Requirements for Nomination and Candidacy:
Any individual who is a member of NYSUT and of AFT for at least one (1) year immediately preceding the April 10, 2008, deadline for nominations shall be eligible to be a candidate for AFT State Delegate or Alternate AFT State Delegate. Any member of NYSUT and of the AFT may nominate a candidate to be either an AFT State Delegate or an Alternate AFT State Delegate.
2. Electors:
All delegates to the 2008 NYSUT Representative Assembly shall be eligible to vote for AFT State Delegates and Alternate AFT State Delegates.
3. Tabulation:
AFT State Delegates and Alternate Delegates shall be elected by a weighted roll call vote. The four candidates with the highest vote total for State Delegate and for Alternate State Delegate shall be elected AFT State Delegate and Alternate AFT State Delegate, respectively.
C. NYSUT AT-LARGE DIRECTORS REPRESENTING THE MEMBERSHIP OF THE FORMER NEA/NY:
(To be elected by delegates from the former NEA/NY locals)
1. Eligibility Requirements for Nomination and Candidacy:
Any member in good standing (with both NYSUT and a local affiliated with the former NEA/NY on August 31, 2006) at the time of nomination may nominate a candidate to serve as an At-Large Director from the NYSUT clustered Election Districts (A/B & C/D). All NYSUT members from a local affiliated with the former NEA/NY on August 31, 2006, may be a candidate to serve as At-Large Director from the NYSUT clustered Election Districts (A/B & C/D) encompassing the member’s local.
2. Electors:
All in-service and retiree delegates elected from locals which were affiliated with the former NEA/NY on August 31, 2006, shall be eligible to cast votes for the two At-Large Director candidates for the NYSUT clustered Election Districts (A/B & C/D) representing the membership from the former NEA/NY locals.
3. Tabulation:
At-Large Directors shall be elected by a weighted roll call vote of all votes cast (NYSUT Constitution Article VIII §1(c), Article IX §5(c) and NYSUT Bylaw C (1)(b)). The candidate with the highest vote total in each of the two clustered Election Districts (A/B and C/D) shall be elected NYSUT At-Large Director.
D. NYSUT GEOGRAPHIC ELECTION DISTRICT DIRECTORS REPRESENTING THE MEMBERSHIP OF THE FORMER NEA/NY:
(To be elected by delegates from the former NEA/NY locals)
1. Eligibility Requirements for Nomination and Candidacy:
Any in-service member in good standing (with both NYSUT and a local affiliated with the former NEA/NY on August 31, 2006) at the time of nomination may nominate a candidate to serve as a Director from the NYSUT Election Districts encompassing the member’s local. Any NYSUT member in good standing from a local affiliated with the former NEA/NY on August 31, 2006, may be a candidate for Director from the NYSUT Election District encompassing the member’s local.
2. Electors:
Delegates representing in-service NYSUT members from a local in good standing with NYSUT, which local was affiliated with the former NEA/NY on August 31, 2006, shall be eligible to cast votes for Election District Director candidate for the Election District where the delegate’s local is situated.
3. Tabulation:
Directors shall be elected by a weighted roll call vote of the ballots cast by the delegates comprising the applicable constituency. (NYSUT Constitution Article VIII §1(c), Article IX §5(a) and NYSUT Bylaw C (1)(b)). The candidate with the highest vote total in each of the four Election Districts (A, B, C and D) shall be elected NYSUT Director.
E. RETIREE AT-LARGE DIRECTOR REPRESENTING THE LIFETIME NEA RETIREE MEMBERSHIP OF THE FORMER NEA/NY:
(To be elected by delegates from the former NEA/NY locals)
1. Eligibility Requirements for Nomination and Candidacy:
Any in-service member in good standing (with both NYSUT and a local affiliated with the former NEA/NY as of August 31, 2006) and any NEA lifetime retiree member in good standing from locals affiliated with the former NEA/NY on August 31, 2006, at the time of nomination, may nominate a Retiree At-large Director candidate.
Any NEA lifetime retiree member in good standing with NYSUT at the time of nomination/election, and who is a former member of a local affiliated with the NEA/NY on August 31, 2006, and who is not otherwise a member of an existing NYSUT Retiree Council or an active (in-service) member of a NYSUT local, may be a candidate for the Retiree At-large Director seat.
2. Electors:
All in-service and retiree delegates to the NYSUT RA who were elected, respectively, by the in-service members and NEA lifetime retiree members from locals affiliated with the former NEA/NY on August 31, 2006, shall be eligible to cast votes for the NYSUT Retiree At-large Director position for the former NEA/NY locals.
3. Tabulation:
The NYSUT Retiree At-large Director shall be elected by a weighted roll call vote, pursuant to NYSUT Constitution Article VIII §1(c), Article IX (5)(c) and Bylaw C(1)(b). The candidate with the highest vote total shall be elected NYSUT Retiree At-large Director.
F. NYSUT AT-LARGE DIRECTORS REPRESENTING THE MEMBERSHIP OF THE PRE-UNIFICATION NYSUT LOCALS:
(To be elected by delegates from the pre-unification NYSUT locals)
1. Eligibility Requirements for Nomination and Candidacy:
Any member in good standing with NYSUT who is a member of a pre-unification NYSUT local, at the time of nomination, may nominate a candidate to serve as an At-Large Director.
To be a candidate to serve as At-Large Director from a NYSUT clustered Election District, the candidate must be a member of a local which situated within the clustered Election District. To be a candidate to serve as At-Large Director for a statewide constituency group, the candidate must be a member the constituency group.
2. Electors:
All in-service and retiree delegates from pre-unification NYSUT locals shall be eligible to cast votes for all of the At-Large Director positions representing the membership of the pre-unification NYSUT locals.
3. Tabulation:
At-Large Directors shall be elected by a weighted roll call vote of all votes cast (NYSUT Constitution Article VIII §1(c), Article IX §5(c) and NYSUT Bylaw C (1)(b)). The candidate with the highest vote total for each of the clustered Election Districts and for the statewide constituency At-Large Election Districts shall be elected NYSUT At-Large Director.
G. NYSUT GEOGRAPHIC ELECTION DISTRICT DIRECTORS REPRESENTING THE MEMBERSHIP OF PRE-UNIFICATION NYSUT LOCALS:
(To be elected by delegates from the pre-unification NYSUT locals)
1. Eligibility Requirements for Nomination and Candidacy:
Any in-service member in good standing (with both NYSUT, and a pre-unification NYSUT local) at the time of nomination may nominate a candidate to serve as a Director from the NYSUT Election Districts encompassing the member's local. Any NYSUT member from a pre-unification local may be a candidate for Director from the NYSUT Election District encompassing the member's local.
2. Electors:
A delegate representing in-service NYSUT members from a pre-unification NYSUT local which is in good standing with NYSUT, shall be eligible to cast votes in the election of the Election District Director for the Election District where the delegate's local is situated.
3. Tabulation:
Directors shall be elected by a weighted roll call vote of the ballots cast by the delegates comprising the applicable constituency. (NYSUT Constitution Article VIII §1(c), Article IX §5(a) and NYSUT Bylaw C (1)(b)). The candidate with the highest vote total in each Election District shall be elected NYSUT Director from the Election District.
VI. CANDIDATE NOMINATION & ACCEPTANCE PROCESS
A candidate is any member in good standing who meets the eligibility requirements for the position and fulfills the requirements for nomination listed below.
A. NOMINATION PROCEDURE

1. Nominating Petition Requirements:
For Positions to be Elected
by All Delegates
NYSUT Officer: Nominating Petitions, containing signatures of at least 50 in-service or retiree NYSUT members in good standing, must be submitted to the NYSUT Elections Committee by no later than 12:00 noon, April 10, 2008.
AFT State Delegate and Alternate State Delegate: Nominating Petitions, containing signatures of at least 50 NYSUT/AFT members in good standing, must be submitted to the NYSUT Elections Committee by no later than 12:00 noon, April 10, 2008.
For Positions to be elected by Delegates from Former NEA/NY Locals
At-Large Directors (A/B & C/D): A Nominating Petition containing signatures of at least eight (8) in-service or retiree NYSUT members in good standing from locals affiliated with NEA/NY on August 31, 2006, must be submitted to the NYSUT Elections Committee by no later than 12:00 noon, April 10, 2008.
Retiree At-large Director: A Nominating Petition, signed by at least eight (8) in-service NYSUT and/or NEA lifetime retiree members in good standing from locals affiliated with NEA/NY on August 31, 2006, must be submitted to the NYSUT Elections Committee by 12:00 noon, April 10, 2008.
Election District (A, B, C & D Election Districts) Director: A Nominating Petition, signed by at least, two (2) in-service NYSUT members in good standing from locals affiliated with NEA/NY on August 31, 2006, which are situated within the Election District that the candidate seeks to represent, must be submitted to the NYSUT Elections Committee by 12:00 noon, April 10, 2008.
For Positions to be elected By Delegates from Pre-Unification NYSUT Locals
At-Large Directors: A Nominating Petition, containing signatures of at least eight (8) in-service or retiree NYSUT members in good standing from pre-unification NYSUT locals, must be submitted to the NYSUT Elections Committee by no later than 12:00 noon, April 10, 2008.
Election District Director (Numeric Election Districts): A Nominating Petition, signed by at least two (2) in-service NYSUT members in good standing from pre-unification NYSUT locals, which are situated within the Election District that the candidate seeks to represent, must be submitted to the NYSUT Elections Committee by 12:00 noon, April 10, 2008.
2. Acceptance of Candidacy/Candidate Name Verification:
Acceptance of Nomination: In order to qualify as a candidate for any position the candidate must signify his/her acceptance of the nomination by signing the Acceptance of Candidacy portion of the Nominating Petition.
Name Verification: Each candidate is also requested to indicate on the Nominating Petition the manner in which his/her name should be printed on the election ballot.
3. Deadline for Nominations:
Nominating Petitions for all position will be accepted by the NYSUT Election Committee at the NYSUT Election Committee table at the Representative Assembly through 12:00 noon, Thursday, April 10, 2008.
4. Candidates Ability to Verify Election Committee’s Receipt of Nominating Petition:
Nominees for any position who wish to verify, prior to the RA, the Committee’s receipt of their nominating petitions by the Elections Committee, may contact the NYSUT Elections Committee at NYSUT Headquarters either in writing ( 800 Troy-Schenectady Road, Latham, New York 12110-2455) or by telephone ((800) 342-9810, Ext. 6663).
Nominees for all positions who wish to verify, at the Representative Assembly, the Committee’s receipt of their nominating petitions by the Elections Committee, must report to the Elections Committee table at the Representative Assembly during the following times: Thursday, April 10, 2008, from 9:30 a.m. to 7:00 p.m.
5. Multiple Candidacies:
No member may be a nominee for more than one elected position, except candidates for AFT State Delegate and AFT Alternate State Delegate. Candidates for these positions may be a candidate for no more than one additional elected NYSUT position.
VII. PUBLICATION OF NOTICE OF NOMINATION AND ELECTION CAMPAIGN AND ELECTION PROCEDURES
This Notice of Nomination and Election and Campaign & Election Procedures will appear in the January 17, 2008, issue of the New York Teacher. It shall also be posted on the NYSUT Web site (http://www.nysut.org/) beginning on January 17, 2008.
An announcement of the January 17, 2008, New York Teacher publication of this notice and of these election procedures shall also be contained: (a) in the January 18, 2008, NYSUT Leader, and (b) in the January 31, 2008, and February 14, 2008, issues of the New York Teacher.
Nominating Petitions will be made available from the NYSUT Elections Committee commencing January 17, 2008.
VIII. MARCH 13, 2008, ELECTION EDITION OF NEW YORK TEACHER, ANNOUNCED CANDIDATES AND RECOGNIZED CAUCUSES
A. ANNOUNCED CANDIDATES
An “announced candidate” is any qualified candidate who announces his/her intention to seek nomination for an elected position and who, by the close of business on February 25, 2008, either: (a) submits an Announcement of Candidacy form to the NYSUT Elections Committee; or (b) becomes a duly nominated candidate by the submission of a properly completed Nominating Petition which has been accepted by the Elections Committee.
An Announcement of Candidacy form or a properly completed Nominating Petition must be timely submitted if a candidate wishes to promote his/her candidacy in the New York Teacher March 13, 2008, Election Edition, and/or if he/she intends to request a delegate mailing list for campaign purposes.
If a candidate’s Nominating Petition has been accepted by the Elections Committee or if an Announcement of Candidacy form has been timely received by the NYSUT Elections Committee from a qualified candidate, and if the candidate wishes to have published a Campaign statement in the March 13, 2008, election issue of the New York Teacher, he/she must submit his/her/their Campaign statement to the Election Committee by no later than the close of business on February 25, 2008.
B. RECOGNIZED POLITICAL CAUCUSES
Organizations wishing to be recognized by the Election Committee as a political caucus under the Campaign and Election Procedures, and thereby receive all accommodations afforded a caucus, shall request and properly complete a Caucus Recognition Petition form. That form is available from the NYSUT Elections Committee. The deadline for the submission of the Caucus Recognition Petition form to the Elections Committee is April 10, 2008, at 12:00 noon.
The Caucus Recognition Petition form must be properly completed and received by the NYSUT Election Committee by no later than February 25, 2008, in order for the caucus to be eligible to have a caucus identified campaign statement published in the March 13, 2008 edition of the New York Teacher.
C. NEW YORK TEACHER “ELECTION ISSUE”
The New York Teacher dated March 13, 2008, shall be the “election issue” which may be used by an “announced candidate” to promote his/her candidacy for a position, provided the following qualifications are fulfilled. In order to be published in the New York Teacher March 13, 2008, election issue a candidate's statement must be provided to the NYSUT Elections Committee by February 25, 2008.
Space in the New York Teacher March 13, 2008, election issue for campaign statements shall be allocated as shown on the chart on this page.
IX. DELEGATE MAILING LISTS
Announced candidates for statewide positions of NYSUT Officer, At-large Director, State AFT Delegate or Alternate Delegate are eligible, upon written request to the Elections Committee, to receive a mailing list of the applicable delegate constituency.
Announced candidates for Election District Directors are eligible, upon written request to the Elections Committee, to receive a mailing list of delegates from the applicable election district/constituency.
Announced candidates are eligible, upon written request to the Elections Committee, to receive one mailing list. The deadline for locals to submit their Election Certification Reports is February 25, 2008. Therefore, complete delegate mailing lists will not be available until after that date.
X. NOMINEES FORUM
A. STATEWIDE OFFICES NOMINEES’ FORUM
Nominees for NYSUT Officers, NYSUT At-Large Directors and State Federation Delegates to the AFT Convention (“statewide offices”) shall be given the opportunity to speak (if requested to participate as specified) to the RA during the Nominees’ Forum which, if necessary, is to be held at 7:00 a.m. on April 11, 2008. In order to be eligible to participate in a Nominees’ Forum for any of the statewide offices, a candidate must sign and complete the Nominees Forum participant request form which will be located at the Elections Committee table on April 10, 2008, between 9:30 a.m. and 12:00 noon. The Elections Committee will have available the final Nominees’ Forum participant roster (and room locations) on April 10, 2008, from 12:00 noon to 7:00 p.m. The time allocated shall be divided equally among the nominees for the same position. Order of speaking shall be determined by lot. Groups of nominees may pool their time. If there is a single slate of candidates for the above offices, the Nominees’ Forum need not be held. The NYSUT Elections Committee will announce during the General Session, to be held on April 10, 2008, at 7:00 p.m., whether there will be any Nominees’ Forum conducted for any of the statewide offices and, if so, the time and location of the Nominees’ Forum(s), if any.
B. ELECTION DISTRICT DIRECTOR (GEOGRAPHIC) NOMINEES’ FORUM
All nominees for Election District Director (geographic) shall have the opportunity to speak at the Election District Directors Nominees’ Forum which, if necessary, is to be held at Election District meetings rooms at the RA commencing at 8:00 a.m. on April 11, 2008. Each Election District Nominee who desires to speak must submit a Nominees’ Forum participant request form to the NYSUT Elections Committee by the April 10, 2008, 12:00 noon filing deadline. The Elections Committee will have available the final Nominees’ Forum participant roster (and room locations) on April 10, 2008, from 12:00 noon to 7:00 p.m. The time allocated shall be divided equally among the nominees for the same position. Order of speaking shall be determined by lot.

XI. CAMPAIGNING
Campaign material shall not be distributed on the Representative Assembly convention floor or in or around voting areas.
Campaigning at the NYSUT Representative Assembly shall end on April 11, 2008, at 8:30 a.m.
NYSUT staff members are prohibited by law from campaigning. Therefore, no candidate should request any campaign assistance from any NYSUT staff member.
XII. CONDUCTING ELECTION
All elections shall be conducted in accordance with the following instructions, and those provided by the NYSUT Elections Committee.
A. VOTES ALLOCATED PER LOCAL
Each local will be apprised at the time of balloting of number of its votes based on membership as defined in the NYSUT Constitution.
B. ELECTION DISTRICT ELECTIONS COMMITTEE
Each Election District Director shall appoint a District Elections Committee composed of delegates from that district, none of whom shall be a candidate for any position to be filled. The District Elections Committee shall elect a Chairperson and Vice Chairperson who, with the Committee, shall be responsible for conducting elections in accordance with the instructions they will receive from the Representative Assembly Elections Committee Chairperson.
Each Election District Election Committee Chairperson will conduct the election according to the following procedure:
1. The ED Election Committee Chairperson will pick up and sign for all of the ballots and a list of eligible voters for all of the locals in his/her Election District.
2. The ballots will be distributed to the Ranking Delegate (delegation chair) of each local as indicated on the list of eligible voters.
3. The Ranking Delegate of each local will distribute the ballots to each eligible voting delegate.
4. The eligible delegates will vote, sign their ballots, and return the ballots to the local's Ranking Delegate.
5. After tabulation of the ED Director ballots, the Ranking Delegate will collect all ballots, and return them to the Election District Election Committee.
6. The ED Election Committee Chairperson will return the ballots to the Representative Assembly Election Committee.
C. VOTING TABULATION & ELECTIONS REPORTING
The Representative Assembly Election Committee will tabulate the results according to Article C, Section 1b of NYSUT’s Bylaws, which states: “The votes of a local or retiree council shall be divided equally among the delegates present at the time of voting. Votes shall be divided evenly to four (4) decimal positions by the Elections Committee at the time of tabulation. Election results will be reported by rounding results to zero decimal positions.”
Write-in votes will not be counted nor be part of any tabulation.
Final election results will be announced at the General Session. Tabulation vote totals will be reported in the next available Representative Assembly Reporter.
D. TIME AND DATE OF ELECTIONS
In order to be eligible to vote at the NYSUT Representative Assembly a delegate must be registered and must be present at her/his assigned voting locations on April 11, 2008, at 8:30 a.m. After 8:45 a.m., any delegate not at her/his assigned voting location will not be able to vote. Instructions on voting, distribution of ballots and voting will begin at each voting location promptly on April 11, 2008, at 8:45 a.m.
E. UNFORESEEN CIRCUMSTANCES
IMPORTANT NOTICE: In the event that unforeseen circumstances, in the judgment of the NYSUT Elections Committee, necessitate altering any of the campaign and election procedures or delaying the elections, all delegates will be afforded advanced notification of the change or the delay and, if applicable, the rescheduled election time.
XIII. RUNOFF PROCEDURE
Should a second balloting be necessary to determine the results of an election, the two nominees with the highest number of votes in the first election will be runoff nominees. In the event that there is a tie for the second highest number of votes, the candidate receiving the highest number of votes and all candidates tied for second will be placed on the second ballot. The meeting must remain in session and roll call voting will continue until there are no more than two candidates on the ballot.

XV. SPECIAL ELECTION
PROCEDURES
In the event of a vacancy in a NYSUT officer position, in an at-large director position or in a geographic election district director office, which occurs between election year Representative Assemblies, the following specified election procedures shall apply:
A. PROCEDURE TO FILL AN OFFICER VACANCY, OR AN AT-LARGE VACANCY ON THE NYSUT BOARD OF DIRECTORS
Pursuant to NYSUT Constitution, Article IX §7(o), the NYSUT Board of Directors is empowered to fill all officer and all at-large director vacancies that may occur between election year Representative Assemblies. The following procedures shall apply in either instance:
1. Upon determination by the President that a vacancy exists, an election date shall be set. The election shall be not less than forty-five (45) nor more than ninety (90) days from such determination.
2. A notice of vacancy will be published in the New York Teacher and posted on http://www.nysut.org/. That notice shall provide at least twenty (20) days for the filing of nominations with the Office of the President.
3. Nominations must be accompanied by a petition signed by at least fifty (50) NYSUT members in the case of an officer position and at least eight (8) NYSUT members in the case of an at-large director position. The nominating petition shall include each member's name, his/her local, and his/her NYSUT identification number or the last four digits of his/her Social Security number.
4. The election will be by roll call vote of the members of the NYSUT Board of Directors. A majority vote is required for election. Should a second balloting be necessary to determine the results of an election, the two nominees with the highest number of votes in the first election will be nominees. In the event that there is a tie for the second highest number of votes, the candidate with the highest number of votes and all candidates tied for second shall be placed on the second ballot. The meeting must remain in session until there are no more than two candidates on the ballot, and one candidate is elected by the Board.
5. If there is only one candidate, the Secretary-Treasurer shall be directed to cast a single vote on behalf of that candidate.
6. The person elected shall serve the unexpired term.
B. PROCEDURE TO FILL AN ELECTION DISTRICT VACANCY ON THE NYSUT BOARD OF DIRECTORS
1. The President shall call a special meeting of all duly certified representatives within the election district for the purpose of electing a successor district director to serve the balance of the unexpired term.
2. NYSUT members who were reported as the elected delegates to the most recently conducted Representative Assembly shall be eligible to vote in the special election conducted within the election district. Any reported elected alternate to the most recently conducted Representative Assembly may vote in the absence of a delegate from the same local or council (NYSUT Constitution, Article IX, §(5)(b)).
